DECLINE, v. Sc. law: to reject formally the jurisdiction of (see Declinature).Sc. 1890 Bell Dict. Law Scot. 292:
A judge may also be declined . . . where either the judge or his near kinsman has an interest in the cause.
Gall. 1704 in Scots Mag. (March 1808) 164–165:
He may be declined by either party in the cause from ever voating thereafter thereintill. . . . The said James Fergusone did, with all humility, and deference, for ever decline the said Earle from voating hereafter in this cause.
