Institute, n.2 [L. institūtus, (the person) instituted (as heir).] ‘The person to whom an estate is first given in a destination’ (Bell). Cf. Institute p.p. 2 c, Institutio(u)n n. 6. — 1681 Stair Inst. iii. viii. § 18.
Substitution is the nomination of substituted heirs, who take place, failing the institute Ib.
If he or his should be extinct who was institute the heretage … falls not to the substitute … but to the heirs of the institute
