DEBITUM FUNDI, n. “A real debt or lien over land, which attaches to the land itself, into whose hands soever it may come” (Sc. 1890 Bell Dict. Law Scot. 286), e.g. a feu-duty.Sc. 1754 J. Erskine Princ. Law Scot. ii. v. 22:
The superiour can recover this casuality, both by a poynding of the ground, as a debitum fundi, and by a personal action against the heir.
