REPROBATE, v. Sc. usages in Sc. Law, gen. in phrs. opposed to approbate: to reject, refuse as binding, of an instrument or deed.Sc. 1773 Erskine Institute iii. iii. § 49:
The grantee does not in such case approbate and reprobate the same deed.
Sc. 1824 Scott Redgauntlet Let. xiii.:
And now would you approbate and reprobate in the same breath of your mouth?
Sc. 1838 W. Bell Dict. Law Scot. 54:
A person is said to approbate and reprobate, where he takes the advantage of one part of a deed, but rejects the rest.
