LIQUIDATE, v. Sc. usage in pa.p. liquidat(e), ascertained and fixed in amount, freq. in regard to a stipulated penalty in case of breach of contract.Gsw. 1700 Gsw. Charters (1906) II. 287:
The sum of two thousand merks good and usuall Scots money forsaid of liquidat penalty and expenses in case of failzie.
Ags. 1729 Arbroath T.C. Rec. MS. (17 Feb.):
A Bond to be drawn and subscribed by the said Magistrats and Councell payable to Hendry Dall for the sume of tuo hunder pound Scots money payable with one years annual rent at Candlemase next with ordinary liquidat expences.
